Top Dawg Electronics ("TD") warrants to you, the original retail purchaser ("Consumer"), that this product ("Product") will under normal use operate properly for a period of one (1) year from the date of the original purchase (the “Warranty Period”) by the Consumer. If a defect arises within the Warranty Period, Consumer's sole and exclusive remedy and TD’s sole and exclusive responsibility under this limited warranty will be, at TD’s (or its authorized reseller’s) option and to the extent permitted by law, either to repair or replace, the defective Product during the one (1) year limited warranty period so that it performs substantially in accordance with the accompanying documentation on the date of your initial purchase. Any replacement may be, at the option of TD, a new or remanufactured Product. If TD (or its authorized reseller’s), in its sole discretion, determines it is not reasonable to replace the defective Product, TD (or its authorized reseller’s) may refund to Consumer the purchase price paid for the Product. The terms of this limited warranty shall not affect and shall be in addition to the statutory rights of the Consumer.

The foregoing warranty is limited and is not applicable to: (i) normal wear and tear; (ii) defects or damage caused by misuse, accident (including without limitation collision, fire and the spillage of food or liquid), neglect, abuse, unusual stress, improper or unauthorized alteration, modification or repair, installation, alteration, wiring, or testing, improper storage, use in an unapproved device or if the serial number has been removed or defaced; (iii) use not in accordance with the documentation accompanying the Product at the time of initial purchase; and (iv) damage caused by third party equipment with which the Product is used.



To obtain the warranty service for any Product that has been directly purchased from TD or any authorized reseller [(whether on our website or otherwise)] and which is subject to the foregoing warranty, Consumer must first notify TD to obtain a Return Material Authorization ("RMA"). Once the RMA has been received by the Consumer, the Consumer return the defective Product together with proof of purchase to the address specified by TD in the RMA. The Consumer shall bear the cost of shipping the Product to TD and TD shall bear the cost of shipping the Product back to the Consumer after the completion of service under this limited warranty. Any Product returned to TD without an RMA or without proof of purchase will be returned to Consumer at Consumer's cost.


The limited warranty extends only to Consumers and is not assignable or transferable to any subsequent purchaser or user.

This limited warranty set forth above gives you specific legal rights. You may also have other statutory rights, which vary from country to country. TD’s responsibility for defects in the product is limited to the repair or replacement service detailed above and as determined by TD. Except as described in section 2, all other warranties of any kind, whether express, implied, statutory or otherwise, including without limitation any warranties of merchantability, fitness for a particular use or purpose, non-infringement and quality are hereby disclaimed. Save to the extent permitted by law no warranties, whether express or implied, will apply after the expiration of the limited warranty period. TD does not warrant that the product is error free or that it will function without interruption. To the extent TD may not, as a matter of applicable law, disclaim certain implied warranties, the duration of any such implied warranty shall be limited to the shorter of the one (1) year limited warranty period or the minimum time period permitted under such law. Some jurisdictions do not allow limitations on the duration of implied warranties, so the above limitation may not apply to you.

In no event will TD be liable for any special, indirect, incidental, punitive or consequential damages of any nature whatsoever including but not limited to loss of profits or revenues, loss of data, loss of use of the product or any associated equipment, cost of any replacement goods or substitute equipment, loss of use during the period that the product is being repaired, claims of any third parties, or any other damages arising from td's breach of this limited warranty or the use of the product, regardless of the form of action whether in contract, tort (including negligence) or any other legal or equitable theory, even if td has been advised of the possibility of such damages. in no event will td's total cumulative liability for any direct losses arising our of or in connection with the use of the product exceed the price paid by consumer for the product.Some jurisdictions do not allow the exclusion or limitation of certain types of losses or (including but not limited to, the exclusion or limitation of incidental or consequential loss), so the above limitation or exclusion may not apply to you and the local law of your normal country of residence may apply in this instance.

Notwithstanding the foregoing, TD does not exclude in anyway its liability for death or personal injury caused by TD's negligence, nor for any other liability which cannot be excluded by law.

Overview of Program:
The warranty extends to the original purchaser of equipment & is non-transferable. If the replacement program is purchased at the time of the equipment purchase, then the replacement program is activated 7 days later. If you purchase the replacement program after the equipment purchase, then there is a 30 day waiting period before the replacement program goes into effect. If the product fails to operate or is damaged because of a manufacturer defect, for the one (1) or two (2) year period (depending upon which replacement program you chose), then Top Dawg will replace with new or refurbished equipment or repair your accessory up to 1 (one) time per calendar year.

If the product is defective because of customer abuse or neglect, then the customer must pay a $12 deductible (price depending upon the price of the product) to receive a new or refurbished replacement. If we agree to replace your product, then Top Dawg will replace with same product (if in stock) or a like product. It there is not a similar product in stock, then you will have the choice to wait for Top Dawg to ship you the new product or you can pay the difference for a different product in stock. Top Dawg also reserves the right to replace the product with a like-new unit, so the product may not be brand new.

If you required expedited shipping, then you will pay for any shipping service other than USPS. Top Dawg will ship via USPS at no cost. In order for Top Dawg to exchange defective or damaged product, contact Top Dawg corporate office. You must have damaged or defective product with a purchase receipt/invoice for replacement program. If you do not have all of the original accessories, then TOP DAWG will only replace what was presented to TOP DAWG. If your headset or accessory was lost or stolen, then you can receive one (1) replacement per year, but you must pay for a lost/stolen deductible that is listed below. Any replacement headset or accessory that was lost or stolen may be replaced at a TOP DAWG location, but we reserve the right to ship it at our discretion via UPS Ground or USPS priority within 2 business days. Lost or Stolen Deductibles are $30. Top Dawg Replacement Program is non-refundable.

How to Replace Your Headset or Accessory:
Call TOP DAWG corporate at 512-251-8472. Your claim must be accompanied by the item being replaced or deductible (if headset was lost or stolen), your name, address, phone number and a copy of the invoice that includes the headset replacement program and includes a headset being serviced or replaced on this SAME invoice. You will be responsible to ship back the defective product to TOP DAWG corporate for service but TOP DAWG will pay for shipping costs to ship back replacement product. Top Dawg Replacement Program is non-refundable.

There are no other express or implied warranties, whether written or oral, other than this printed limited warranty. All implied warranties, including, without limitation, the implied warranties of the merchantability or fitness for a particular purpose, are limited to the duratation of this limited warranty. In no event shall the company be liable for incidental or consequential damages of any lost profits or commercial loss to the full extent of those damages can be disclaimed by law. By my acceptance of invoice with headset or accessory replacement program, I understand and agree that the company’s interpretation of such terms shall be final and binding.
